‘Approach High Courts First’ Supreme Court Tells the Parents of 8 States- The Supreme Court while rejecting the petitions filed by the parents from the 8 states has asked them to approach the respective high courts first as a jurisdictional court.

The parents had prayed for the ad interim reliefs for prohibition on the conduct of physical classes till the vaccine for the Covid-19 disease is discovered or it is declared non fatal for the children, prohibition of the expulsion of the students for non payment of the fees, prohibition on ban of  online classes till the nation wide safety mechanism against eye strain, cyber bullying or sexual exploitation is formed.

The petition had further prayed for the waiver of the fees till the lockdown is continued, alternative prayer of the collection of tuition fees only without any hidden charges, or allow the schools to recover the fees based upon the actual cost & not to continue recover as per the previous year’s fee etc.

The main petitioner Mr.Sushil Sharma said ‘It is unfortunate that the Supreme Court has not taken the cognizance of the matter as we believe that it is the perfect scenario for apex body to intervene as the whole nation has suffered equally in this pandemic situation and that prayers we prayed for were uniform and could easily be applicable to each and every state.’

‘This was first such united attempt of the parents belonging to the 8 states to launch collective fight legally unlike the most school associations who are professionally well organized. Hence in other way, for parent’s unity aspect, it was big success for us to stand united, approach the judicial forums collectively. Also the matter is not heard on merit and hence there is still complete scope to raise the issues before high courts, we would soon be intervening in pending matters before the many high courts and we are accordingly making our future plan of action with our legal team and believe that the justice will be delivered soon.’ Added Mr.Sharma.

The other petitioners who represented their respective states are Dr.Gagan Raut (Odisha), Mr.Varun Khanna (Punjab), Mr.Gaurav Barot (Gujarat), Mr.Kailash Chand (Haryana), Mr.Arif Khan (Uttarakhand), Mr.Attul Raheja (Delhi), Mr.Prasad Tulaskar, Mr.Rajesh Badnakhe & Mr.Sanjay Joshi (All from Maharashtra).
