Anti Parents Amendments Carried Out in Fee Regulation Act in Maharashtra

The government of Maharashtra has carried out pro school Management & anti parents amendment which would help the school managements to commercialize the education without any hurdle or any effective check. Shockingly it has been revealed that such an amendment was carried out secretly prior to the general assembly election held recently.

We had already published an article when the state government had secretly presented the amendment bill before the legislative council earlier. However the opposition from the social activists and even the differences between the ruling political parties had then given setback to the government to move ahead with such an amendment plan.

However it has been recently revealed that the government has secretly carried out the pro school management and anti parents amendment on 26th August 2019 prior to the recently held general assembly election of the State of Maharashtra. The Maharashtra Educational Institutions Regulation of Fee Act 2011 has been now officially amended with The Maharashtra Educational Institutions Regulation of Fee (Amendment) Act 2018 which has given the setback to the parents all over the state.

Details of the Pro School Management & Anti Parent Amendment-
The Maharashtra Educational Institutions Regulation of Fee (Amendment) Act 2018 has brought pro school management & anti parent amendments as follows-
1) The most criticized declaration of amendment proposal of the then Education Minister Mr.Vinod Tawde of 25% parents’ ‘must approval’ for complaining or challenging the approved fee of the school management before the fee regulatory committee or otherwise, has been approved.

2) The Section 16 of the act which provided for the fine of the twice of the illegally collected amount by any school has been scrapped. It is pertinent to note that since the act was enacted no fine was imposed by the state government on its own against any errant school till date.
3) Another most shocking amendment of allowing the school managements to recover the interest & even fine from the parents for delay in the fees has been approved.

4) Also fee regulation act amendment empowers the school management to hike the fees overriding the 2 years binding fee clause if the 76% of the parents approve such hike in an extraordinary circumstances. However no provision is made that if the 76% of the parents pass such resolution the hiked fees can be rolled back.

5) The amendment has deleted the provision of 2 joint secretaries among the parents in the Parent Teacher Association’s Executive Committee & now it has  has been replaced with 1 member from the parent & one among the teachers.
