The Government blocks Child Right Panel’s Functioning With Pre-planned Conspiracy- The Black Face of the Government of Maharashtra Exposed- The information under the Right to Information Act 2005 has exposed the black face of the government of Maharashtra as it has been revealed that even the Chief Minister’s Office along with the Women and Child Development Department has blocked the functioning of the Maharashtra State Commission for Protection of Child Rights by allowing appointment of only 4 posts out of 12 sanctioned by the government itself from past 4 years. Aggrieved with these state of affairs, Mr.Pravin Ghuge, chairman of the Maharashtra State Commission for Protection of Child Rights has taken an unprecedented move before few months issuing the legal notice against Mr.Sumeet Mallik, the Chief Secretary of State of Maharashtra.

Background-
The organization has been providing the legal assistance to the parents whose children have been inflicted punishments of expulsion from school, mental and physical harassment for demand and collection of illegal fees since past one year. In pursuance to this, few parents got success as their expelled children were readmitted to the schools and some schools even refunded the excessive fees taken from the parents. The headmistress of one school was also dismissed post such legal proceedings. The Maharashtra State Commission for Protection of Child Rights had played important role in these proceedings. However immediately after these minor but important success incidents, all of sudden, the working of the commission has been stopped since past few months. The commission has literally not conducted any hearings in past 8-10 months with few exception. Accordingly the organization along with the education activist Mr.Prasad Tulaskar from Mumbai decided to investigate the causes of such inaction which has resulted into such shocking discovery.

‘Conspiracy’ by the Chief Minister’s Office & Women  and  Child  Development  Department Explained with Evidences-
As per the information received by Mr.Prasad Tulaskar from the Maharashtra State Commission for Protection of Child Rights itself, the following shocking information have been revealed-

1) The Maharashtra State Commission for Protection of Child Rights which has been entrusted with the responsibility of the protection of the child rights of the children all over the Maharashtra, has been functioning with only 4 appointed staff than actual sanctioned 12 staff.

2) As per the written statement of the Maharashtra State Commission for Protection of Child Rights itself, the commission had earlier to carry the responsibilities under the Commissions for Protection of Child Rights Act 2005 only but was later entrusted with additional responsibilities under the The Right of Children to Free and Compulsory Education Act 2009, The Protection of Children from Sexual Offences (POCSO) Act 2012 & Juvenile Justice (Care and Protection of Children) Act, 2015. The Supreme Court of India also time to time has entrusted the commission with supervisory role in many matters & also directed the strengthening of the commission to the state governments. However in spite of these facts, the commission has mentioned in their written statement that the because of the inaction from the state government, the functioning of the commission has become practically impossible.

3) One of the most shocking fact revealed from the information provided by the Maharashtra State Commission for Protection of Child Rights is that only because the Administrative Officer is not appointed from many years, the commission has failed to realize the funds it has received from the international bodies like UNICEF! The State Government has not acted upon the repeated request from the commission over the years to appoint Administrative Officer whose signature was required to materialize such funds which resulted into loss of such funds ultimately! Even the funds for the ‘Sarva Shiksha Abhiyan’ failed to be realized for the inaction of the State Government. It is pertinent to note that while central government is spending hundreds of crore rupees on advertisement for ‘Sarva Shiksha Abhiyan’, the state government is not letting the Maharashtra State Commission for Protection of Child Rights to utilize such funds.

4) Few top officers appointed earlier did not bother to attend the hearing of the commission and got themselves transferred to other department.

5) Most Shocking- What could be explained as the worst development for any state government is that, as per the written statement made by the Maharashtra State Commission for Protection of Child Rights, aggrieved with the inaction of the state government to protect the child rights which include their protection of right to education and also serious rights of protection against the sexual offences, the Chairman of the Maharashtra State Commission for Protection of Child Rights, Mr.Pravin Ghuge has served legal notice to Mr.Sumeet Mallik, the Chief Secretary of the State of Maharashtra and has warned to take appropriate action or face legal consequences.

Case Filed Against Top Education Officers at MSCPCR (Maharashtra State Commission for Protection of Child Rights)-The education ministry of Maharashtra is likely to face awkward scenario as its top ranking officers from the ranks of Principal Secretary to the Dty.Director of Education have been impleaded by the parent of the IES Modern English School at Maharashtra State Commission for Protection of Child Rights (MSCPCR) for their gross negligence & willful inaction against the alleged harassment of the children and collection of the illegal fees from the parents.

Explaining this aspect, the parent from the IES Modern English School Smt.Manasi Pathare who has taken such bold move said ‘I had along with other parents of the school filed the case against the management of the IES Modern English School before the Maharashtra State Commission for Protection of Child Rights (MSCPCR) in the year 2016 against the threatening & issuance of White Cards to the children for non payment of fees. As the matter is kept for final recommendation by the Maharashtra State Commission for Protection of Child Rights (MSCPCR) i do not wish to offer more comments at present. However since past two years i have observed the gross negligence & willful inaction from the officers of the rank of the education officers to the Principal Secretary of the department.’

‘They did not even bother to give us report about our grievances which are pending from the years. While the matter was pending before the Maharashtra State Commission for Protection of Child Rights (MSCPCR), my daughter was again expelled for the non payment of fees & even peon was sent to my home to serve the notice though i had cleared the fees under protest. Accordingly i even served the legal notice in February 2018 to the Principal Secretary of the education department that being a public servant they are  bound to take action against the commission of the cognizable offences declared under the existing laws. Yet no action was taken till date. Hence i have prayed for the disciplinary action as well as criminal prosecution against such officers before the Maharashtra State Commission for Protection of Child Rights (MSCPCR)’ added Smt.Pathare.

Confirming the filing of the case Adv.Siddharthshankar Sharma said ”The public officers are bound to take preventive as well as appropriate action against illegalities, failure to do so should result into the disciplinary action as well as criminal prosecution against such officers depending upon the nature of the negligence committed by them.”

The top ranking officers like Smt.Vandana Krishna, Education Commissioner Shri.Vishal Solanki & also the low ranking officer holding the rank of Education Officer as well as additional charge of the Dy.Director of Education Shri.Rajendra Ahire have been impleaded in this case filed before the Maharashtra State Commission for Protection of Child Rights (MSCPCR).

The Maharashtra State Commission for Protection of Child Rights(MSCPCR) has come under scanner as parents have complained and revealed subsequently under the Right to Information reply received from The Maharashtra State Commission for Protection of Child Rights (MSCPCR) itself, which has confirmed the parents allegation true, as the RTI reply reveals that the commission has decided only 11% cases in previous 3 years.

The Commissions for Protection of Child Rights are established at the National as well as State levels under The Commissions for Protection of Childs Rights Act 2005 to ensure that all laws, policies, programmes and administrative mechanisms are in consonance with the child rights perspective as enshrined in the Constitution of India as well as in the United Nation Convention on the Rights of the Child, which India ratified in 1992.

Further these commissions are also empowered to deliver the justice against all types of physical and mental harassment inflicted upon innocent children, to protect them from serious crimes like sexual abuse and to deliver the victim children actual justice, to implement the provisions of the The Right of Children To Free And Compulsory Education Act 2009 etc.

Shocking history of Maharashtra Government to deliberately weaken the MSCPCR-
It is pertinent to note that since the year of 2011 The Maharashtra State Commission for Protection of Child Rights(MSCPCR) is running at snail’s pace for want of non availability of funds as well as shortage of necessary staffs. In the year 2016 in one of the writ petition filed by an NGO, the Hon’ble Bombay High Court had come heavily on the state government for its indifference to take any concrete action for the efficient working of the The Maharashtra State Commission for Protection of Child Rights (MSCPCR). It was after the intervention of the Hon’ble Bombay High Court only the MSCPCR got full time chairman & necessary other staff appointed.

Adjudication of only 33 cases out of 280 cases filed in previous 3 years-
As per the RTI reply received from The Maharashtra State Commission for Protection of Child Rights (MSCPCR) by Mumbai based education activist Mr.Prasad Tulaskar, it has been revealed that the MSCPCR has decided only 33 cases out of 280 filed before it i.e. at the ratio of 11% in the period of 2015 to 2018 of 3 years! Another shocking incident took place recently which proved the fact that it is government of Maharashtra which is deliberately not letting the The Maharashtra State Commission for Protection of Child Rights (MSCPCR) work smoothly when the present chairman Mr.Pravin Ghughe returned the cheque amounting around Rs.56,00,000/- to the state government blaming it grossly insufficient against the actual demand around Rs.90,00,000/- & also objected the permission of appointment of only around 7 staffs against the demand of around 14 staffs made by the MSCPCR.

As usual parents need to solve the issue only with two ways, either to knock the door of the court or to launch decisive protests against the government of Maharashtra.
